Delivery Driver Platform Access Policy

FIRST, AN IMPORTANT MESSAGE: PLEASE READ THESE TERMS AND CONDITIONS OF USE ("Terms", "Terms of Use", or "Agreement") CAREFULLY BEFORE USING THIS APP, AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS, INCLUDING, BUT NOT LIMITED TO, WAIVERS OF RIGHTS, LIMITATION OF LIABILITY, AND YOUR INDEMNITY TO US.THIS AGREEMENT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN COURTS OR JURY TRIALS, AND LIMITS THE REMEDIES AVAILABLE IN THE EVENT OF A DISPUTE.

At Olyns, we are proud to provide a platform to grow and empower local economies and provide people access to flexible work opportunities that allow them to be their own boss, make meaningful money, and explore their community. 

Because we value our business relationship with Delivery Professionals and anyone else who provides services on the Olyns platform, we want to be clear, upfront, and transparent about the kinds of activities that can lead to you losing access to certain opportunities on the Olyns platform as well as how the process of account deactivation works

ACCEPTING AND COMPLETING SERVICES

Background: 

The acceptance rate is the percent of services shown that are accepted and the completion rate is the percent of services completed of those that are accepted. When an opportunity is offered through the Delivery app, key details of the offer are displayed, including the pick-up locations, fill level, and the minimum guaranteed amount of pay. 

As independent contractors, Delivery Professionals have the right to decline any opportunity offered to them. However, accepting an offer is an agreement to complete that service.

How it affects you: 

While by accepting a service you are agreeing to complete that service, we recognize that unforeseen circumstances may arise. You therefore have the right to occasionally not complete a service after you accept it, as long as you cancel before you pick up the items. To provide services on the Olyns platform, however, you must maintain a certain completion rate. As a courtesy you will be notified if your completion rate starts falling near the threshold level. If your completion rate falls below the threshold, you may lose access to certain opportunities or your account may be deactivated.

KEEPING THE PLATFORM SAFE AND SECURE

At Olyns, the safety and security of service providers, retailers and consumers that use the Olyns platform is paramount. We want Delivery Professionals to feel safe when performing services. Creating an unsafe or unsecure environment for anyone on the platform or the communities in which Olyns operates is grounds for immediate account deactivation. These behaviors include, but are not limited to:

  1. Violence or inappropriate behavior, including use of abusive or offensive language - Exhibiting objectively unsafe or offensive behavior, including physical, sexual, or verbal assault
  2. Use of alcohol and drugs - Performing services while under the influence of alcohol or drugs.
  3. Discrimination or harassment - Olyns is committed to providing a platform free from discrimination and harassment and therefore prohibits discrimination and harassment by or directed at Delivery Professionals, merchants, consumers, or Olyns employees because of race, color, sex, gender, national origin, ancestry, religion, creed, physical or mental disability, medical condition, marital status, sexual orientation, age, profession or any basis protected by federal, state, or local law.
  4. Delivery Professionals are prohibited from engaging in any form of disparagement, or disrespectful communication about the Company, its employees, leadership, customers, vendors, business partners, other Delivery Professionals, or any other affiliated parties. This includes verbal statements, written communication, online activity, and social media posts.This includes but is not limited to negative, vulgar, unprofessional, hostile or harmful statements about the Company’s business practices, reputation, products, services, employees, or partners as well as spreading rumors, false information, or unverified claims. Sharing confidential or internal issues or practices can also harm the Company’s interests.
  5. Unsafe driving - Exhibiting objectively unsafe conduct when driving while performing services on the Olyns platform, such as texting and driving, not pulling over before reviewing or accepting a delivery opportunity, or failing to be conscientious while using navigation apps. Delivery Professionals involved in accidents may be subject to deactivation, depending on all facts and circumstances of the accident(s). Negative infractions against one’s driving record may also disqualify a Delivery Professional from use of the Olyns platform.
  6. Failure to comply with the law or use of the platform for any criminal activity - Violating any local, state, or federal law while using the Olyns platform, including any applicable criminal or traffic laws. This includes but is not limited to theft of any goods or items, damage to or theft of any third party property, and use of the Olyns platform to engage in or assist with any potentially criminal activity.
  7. Failure to pass identity verification and screening criteria - Failing to meet Olyns’s identity verification or screening criteria - whether at the time of account creation or any time thereafter - is grounds for being denied access to the Olyns platform or account deactivation if you have already accessed the platform.
  8. Disclosing personal information without authorization - Using personal information for any purpose other than completing services on the Olyns platform, including posting online, saving, or otherwise sharing with any third party, except as may be legally required.
  9. Tampering with material pickup and deliveries, or removing material from delivery bags.

FRAUD OR ABUSE OF THE PLATFORM

Much of the Olyns platform rests on minimum business standards of integrity and fair dealing. We trust Delivery Professionals to use the Olyns platform honestly and with integrity. Accounts of Delivery Professionals that abuse our services or engage in fraud, or that cause others to do the same, will be grounds for deactivation. Examples of abuse and fraud include, but are not limited to:

  1. Providing information that is fraudulent or inaccurate - Misrepresenting information during signup, providing false information to Olyns, merchants, or consumers related to the performance of services, creating multiple accounts for the same individual, using the same phone number as an account already in use, or failing to accurately identify the mode of transportation being used to perform services.
  2. Disrupting the Olyns platform - Taking any action, either directly or indirectly, that is intended to or does damage, disable, interrupt, overburden, or impair the functionality of the Olyns platform or the servers or networks connected to the Olyns Platform.
  3. Scraping - Using any robot, spider, web crawler, extraction software, automated process and/or device to scrape, copy, index, frame, monitor, conduct any systematic retrieval of data or other content from any portion of Olyns platform or its content.
  4. Unauthorized Access - Gaining or attempting to gain unauthorized access to the Olyns platform and/or to any account, resource, computer system, and/or network connected to any Olyns server. This includes any breach or circumvention of any security or authentication measures Olyns may use to prevent or restrict access to the Olyns platform.
  5. Sharing or providing access to your account - Sharing your user ID, password, or any other means of access to your Olyns Delivery account with any other person or entity.
  6. Third party rights - Using Olyns in any way that infringes third party rights, including copyrights, trade secrets, trademarks, or other rights of any third party, including privacy or publicity rights.

VIOLATING THE TERMS OF YOUR CONTRACT

Violating any of the terms of your Independent Contractor Agreement or any other agreement or policy that you agreed to as a condition of accessing the Olyns platform will serve as a valid basis for losing of access to certain opportunities or deactivation from the Olyns platform. This includes but is not limited to:

  1. Failure to Accurately Record Completion of a Service - Marking a service as complete when you did not complete it or indicating that you have completed the requirements of a service when in fact you have not. Likewise, consistent failure to timely mark a service as complete when it has, in fact, been completed.
  2. Failure to Complete Services in a Safe or Timely Manner - Failing to provide and complete services timely and safely.
